Personal data (hereinafter referred to as “data” for the most part) are only processed by us where strictly necessary and in order to provide a functional and user-friendly website, including its contents and the services offered there.

According to Article 4(1) of Regulation (EU) 2016/679, also known as the General Data Protection Regulation (hereinafter referred to as the “GDPR”), “processing” means any operation or set of operations which is performed on personal data or on sets of personal data, whether or not by automated means, such as collection, recording, organisation, structuring, storage, adaptation or alteration, retrieval, consultation, use, disclosure by transmission, dissemination or otherwise making available, alignment or combination, restriction, erasure or destruction.

Through the Privacy Policy set out below, we provide you with information in particular concerning the type, scope, purpose, duration and legal basis of the processing of personal data, in so far as we have alone or jointly with others determined the purposes and means of the processing of personal data. We also provide you with information below on the third-party components we use for optimisation purposes and to increase the quality of use, where this results in third parties processing data under their own responsibility.

II. Rights of users and data subjects

With regard to the data processing described in more detail below, users and data subjects have the right

  • to obtain confirmation as to whether or not personal data concerning them are being processed, and to further information about the data processing and to copies of the data (see also Article 15 GDPR);
  • to the rectification or completion of inaccurate or incomplete data (see also Article 16 GDPR);
  • to the immediate erasure of personal data concerning them (see also Article 17 GDPR) or, alternatively, where further processing is necessary in accordance with Article 17(3) GDPR, to restriction of processing pursuant to Article 18 GDPR;
  • to receive the data concerning them, which they have provided to a controller, and to transmit those data to another provider/controller (see also Article 20 GDPR);
  • to lodge a complaint with a supervisory authority, if the data subject considers that the processing of personal data relating to him or her by the provider infringes the applicable data protection regulations (see also Article 77 GDPR).
Furthermore, the provider undertakes to notify all recipients to whom data has been disclosed by the provider of any correction to or erasure of data, or restriction of processing, which has taken place in accordance with Articles 16, 17(1) and 18 GDPR. However, this obligation shall not exist if the provision of such information proves impossible or involves a disproportionate effort. Nonetheless, the user shall have the right to obtain information about these recipients.

According to Article 21 GDPR, users and data subjects also have the right to object to the future processing of personal data concerning them, in so far as these data are processed by the provider pursuant to Article 6(1)(f) GDPR. In particular, objections against data processing for direct marketing purposes are permitted.

III. Information on data processing

The data that are processed when you use our website are deleted or blocked as soon as the reason for their storage no longer applies and the erasure of the data does not contravene any legal retention requirements, unless otherwise specified below for individual processing operations.

Server data

For technical reasons, in particular in order to ensure a secure and stable website, data are sent to us and/or to our webspace provider by your internet browser. The data collected by these server log files include the type and version of your internet browser, the operating system, the website from which you clicked through to our site (referrer URL), the page(s) of our website that you visit, the date and time of access, and the IP address of the internet connection used to access our website.

The data collected in this manner are stored temporarily, but are not linked to other data concerning you.

This data storage is carried out pursuant to the legal basis set out in Article 6(1)(f) GDPR. Our legitimate interest is the improvement, stability, functionality and security of our website.

The data are deleted after no more than seven days, as long as no further storage is necessary for the purpose of evidence. Otherwise, the data shall be excluded from erasure in full or in part until final clarification of an incident is reached.

We use cookies on our website. Cookies are small text files or other storage technologies that are placed on your device by your internet browser and stored there. These cookies are used to process specific information about you on an individual basis, such as your browser or location data or your IP address.

c) Removal option

Performance of a contract

The data transmitted by you to utilise our range of goods and/or services will be processed by us for the purpose of performance of the contract and are necessary in this respect. Conclusion and processing of the contract are not possible without the provision of your data.

The legal basis for this data processing is Article 6(1)(b) GDPR.

We delete the data once the contract has been fully processed, but must observe the retention periods under tax and commercial law.

In the context of contract processing, we pass on your data to the transport company commissioned with the delivery of goods or to the financial service provider, insofar as the transfer is necessary for the delivery of goods or for payment purposes.

The legal basis for this passing on of data is Article 6(1)(b) GDPR.

Customer account / registration function

If you create a customer/supplier account with us via our website, we will collect and store the data you enter during registration (e.g. your name, your address or your e-mail address) exclusively for pre-contractual services, for the fulfilment of the contract or for the purpose of customer care (e.g. to provide you with an overview of your previous orders with us or to be able to offer you the memo function). At the same time, we store the IP address and the date and time of your registration. This data will not be passed on to third parties.

In the course of the further registration process, your consent to this processing will be obtained and reference will be made to this privacy policy. The data collected by us will be used exclusively for the provision of the customer/supplier account.

If you consent to this processing, Article 6(1)(a) GDPR is the legal basis for the processing.

If the opening of the customer/supplier account also serves pre-contractual measures or the fulfilment of the contract, the legal basis for this processing is also Article 6(1)(b) GDPR.

You can withdraw the consent you have given us to open and maintain the customer/supplier account at any time with effect for the future in accordance with Article 7(3) GDPR. To do this, simply inform us that you wish to withdraw your consent.

The data collected in this respect will be deleted as soon as processing is no longer necessary. However, we must observe retention periods under tax and commercial law.

Credit check and scoring

If we offer you the basic option of payment by invoice as part of our range of goods or services and you make use of this option, we reserve the right to obtain credit information from a credit agency (such as Coface Rating GmbH, Creditreform Leer Bolte KG, Bisnode Deutschland GmbH, CRIF BÜRGEL GmbH Ndl. Hamburg,) on the basis of statistical mathematical procedures. For this purpose, your data will be forwarded to the credit agency if it is relevant to the contract, such as your name and address.

We use the subsequent information on the statistical probability of non-payment to decide whether to offer you payment by invoice. The legal basis for this processing is our legitimate interest in the security of the claim and the prevention of fraud pursuant to Article 6(1)(f) GDPR.

Newsletter

If you sign up for our free newsletter, the data that are collected from you for this purpose – your email address and, optionally, your name and address – are sent to us. We also store the IP address of the internet connection you use to access our website, and the date and time of your signing up. In the next step of the sign-up procedure, we will ask for your permission to send you the newsletter, describe its contents in more detail, and refer to this Privacy Policy. The data we collect in doing so will only be used for the purpose of sending the newsletter – in particular, therefore, these data will not be passed on to third parties.

The legal basis in this case is Article 6(1)(a) GDPR.

You can withdraw your consent for the newsletter at any time with future effect in accordance with Article 7(3) GDPR. To do this, simply inform us that you wish to withdraw your consent, or click the unsubscribe link that can be found in every newsletter.

Contact enquiries/contact options

If you contact us via the contact form or email, the data you submit will be used to process your request. You are required to submit your data so that we can process and respond to your request – if you do not do so, we may only be able to respond to your query to a limited extent, or not at all.

The legal basis for this data processing is Article 6(1)(b) GDPR.

Your data will be erased once your query has been definitively answered as long as this does not contravene any legal retention requirements, for example in the event that a contract is subsequently performed.

User posts, comments and reviews

We provide you with the opportunity to publish questions, answers, opinions and reviews, hereinafter referred to as “posts”, on our internet pages. If you take up this offer, we will process and publish your post, the date and time you submitted it, and the pseudonym you have used, if applicable.

The legal basis in this case is Article 6(1)(a) GDPR. You can withdraw your consent at any time with future effect in accordance with Article 7(3) GDPR. To do this, simply inform us that you wish to withdraw your consent.

We also process your IP address and email address. Your IP address is processed because we have a legitimate interest in initiating or supporting further steps if your post infringes the rights of a third party and/or is otherwise unlawful.

The legal basis in this case is Article 6(1)(f) GDPR. Our legitimate interest is any necessary legal defence.

Online job applications/publication of job vacancies

We offer you the opportunity to apply for jobs with us via our website. When you submit a digital application, your applicant and application data are collected and processed by us electronically so that we can conduct the recruitment procedure.

The legal basis for this data processing is Section 26(1)(1) of the German Federal Data Protection Act (Bundesdatenschutzgesetz, BDSG) in conjunction with Article 88(1) GDPR.

If an employment contract is concluded following the recruitment procedure, we will save the data you submitted with your application to your personnel file for the purpose of facilitating the standard organisational and administrative process, while continuing to comply with our legal obligations.

Here, too, the legal basis for this data processing is Section 26(1)(1) BDSG in conjunction with Article 88(1) GDPR.

If your application is rejected, we automatically delete the data submitted to us six months after notification of the rejection. However, these data shall not be erased if a longer storage period is required – up to four months or until legal proceedings are concluded – for legal reasons, such as the burden of proof in connection with the German General Equal Treatment Act (Allgemeines Gleichbehandlungsgesetz, AGG).

The legal basis in this case is Article 6(1)(f) GDPR and Section 24(1)(2) BDSG. Our legitimate interest is legal defence or law enforcement.

If you explicitly consent to your data being stored for a longer period, for example for inclusion in our database of applicants or interested parties, these data will be further processed according to your consent. The legal basis this case is Article 6(1)(a) GDPR. However, you have the right to withdraw your consent at any time with future effect in accordance with Article 7(3) GDPR by declaring this to us.

Competitions

We offer you the opportunity to take part in competitions via our website. If you take part in one of our competitions, the data you enter when participating will be processed without your further consent, but only for the purpose of organising and running the respective competition.

In the context of running the competition, we pass on your data to the transport company commissioned with the delivery of goods or to a financial service provider, insofar as this passing on of data is necessary for the delivery or payout of your prize.

If your data is published in the event of a win, you will be informed of this as part of the declaration of consent.

We maintain an online presence on YouTube to present our company and our services and to communicate with customers/interested parties. In this respect, we would like to point out that there is a possibility that user data may be processed outside the European Union, in particular in the USA. The Google Analytics service is used to analyse user behaviour on our website. The legal basis is Article 6(1)(f) GDPR. Our legitimate interest is the analysis, optimisation and commercial operation of our website.

Information relating to usage and users, such as IP address, location, time or frequency of visits to our website, is transmitted to a Google server in the USA and stored there. However, we use Google Analytics in conjunction with the anonymisation function. This means that Google truncates the IP address inside the EU or the EEA.

The data collected in this manner is used by Google to provide us with an evaluation of the visits to our website and the user activities carried out there. This data may also be used to provide further services that relate to the use of our website and of the internet. Google states that it does not link your IP address to other data.
